In Tennessee, there are six levels of criminal homicide charges that we will work diligently to defend you against. These include:

First Degree Murder

If you have been charged with first degree murder, you are facing a capital crime with associated penalties. It requires that the act of killing was premeditated and intentional, done during the commitment of another felony, and/or the result of a bomb or other destructive device. Possible sentences include death, life in prison without parole, of life with the possibility of parole.

Second Degree Murder

The conscious killing of another or a death of another resulting from unlawful distribution of Schedule I (LSD, heroin, mescaline) or II (methamphetamines, opium, cocaine) drugs is considered second degree murder. If convicted, you may be facing Class A felony consequences such as 15-25 years in prison.

Voluntary Manslaughter

In the heat of passion, a person may encounter sufficient provocation to elicit irrational behavior. Unfortunately, this irrationality may result in the death of another person; in Tennessee, this is considered a Class C felony voluntary manslaughter. You may face 3-6 years in prison if convicted.

Reckless Homicide

If a person does not intend to harm another individual but can foresee the harmful effects of their actions, the resulting, unintentional death of that person is known as reckless homicide. Although this classification allows for a lower mental culpability, it is still a Class D felony and the conviction carries 2-4 years in prison.

Criminally Negligent Homicide

When the natural and probable result of an individual’s actions is the death of another, Tennessee considers this to be criminally negligent homicide. This murder charge replaced the original charge of involuntary manslaughter and is considered a Class E felony.

Vehicular Homicide

If the death of an individual was the direct result of an automobile, airplane, motorboat, or other motorized vehicle, this may be considered vehicular homicide. Certain provisions must also be met including risky behavior that threatens the health and welfare of another, driver intoxication, drag racing, or driver conduct disregarding posted construction area warnings. Vehicular homicide is a Class D felony with sentences of up to 12 years in prison and a fine of up to $5000.
