Employment/Labor Law
Everyone should be allowed to work in a place free from the stresses of harassment and discrimination. There are many forms of employment related discrimination, and they occur more frequently than most people realize. Of course everyone is protected by Title VII of the Federal Civil Rights Act. Additionally, in Tennessee, you have the protection of the Tennessee Human Rights Act, which is State body of law that parallels the Federal version.
There are very strict requirements in filing and maintaining a cause of action against an employer for any form of discrimination. Many of the statutes of limitations are less than one-year. There may also be internal requirements established by your employer, related to the filing of complaints. It is very important that, if you believe you have been the victim of harassment or discrimination in the workplace, you contact an attorney immediately to determine what rights and obligations you have, and how long you will have to enforce them.
In some cases you are not required to continue to work in a “hostile environment”. However you must take the appropriate steps to insure that your complaint is made, and that your rights are protected. It would be advisable to consult an Attorney prior to resigning from your position. Even though you may be entitled to quit and still assert a complaint for wrongful termination (based upon constructive termination), those cases are more difficult to prove and require very specific evidence of a “hostile work environment”.
